Research question/issue This paper aims to contribute to an improved theoretical and empirical understanding of the role that corporation has to play in anticorruption efforts. Research findings/insights Using cross-country data from three databases (Bribe Payers Index, Corruption Perceptions Index, and Doing Business) we found that pro-bribery Investment Climate conditions in host countries are not related to the payments of bribes by multinational companies when these corporations operate abroad. Theoretical/academic implications After describing the conceptual and policy framework that (...) surrounds the discussion on the role played by firms in anticorruption, we present the current debate regarding the effectiveness of international bribery control instruments, with the World Bank-GAC (2006-2008) report as a basis. Both literature and policy seem to be divided into two main, although not mutually exclusive, positions: one demands improvements in Investment Climate conditions from a joint public-private consensus led by international agencies; the other one supports the effectiveness of self-regulation by firms, independent of Investment Climate improvements. The study provides empirical support to the idea that a better Investment Climate is not enough for reducing corrup tion. Practitioner/policy implications This study offers insights to policy makers interested in promoting the involvement of corporations in the fight against corruption. (shrink)

El método clínico surge desde las relaciones humanas más primitivas y aún cuando se encuentra en constante evolución no se consigue su adecuada aplicación. El estudio de este método científico constituye uno de los temas más importantes que guían la praxis médica, ostenta ciertos caracteres que se entrelazan dialécticamente imposibles de desligar, centrados esencialmente en la relación médico-paciente con el objetivo de arribar al diagnóstico de una enfermedad determinada, por lo cual, se brindan algunas consideraciones teóricas a partir del análisis (...) de sus conceptualizaciones y atributos más significativos y se elabora una definición de método clínico. The clinical method faces constant evolution, in spite of the issues that affect its application. The study of this scientific method constitutes one of the most important topics that lead medical praxis. It entails several characteristics dialectically intertwined that focus mainly on the doctor-patient relation for the diagnosis of a given disease. How should national societies build legitimate and inclusive collective identities amidst prolific multiculturalism and linguistic diversity? We argue that cultural ownership of particular ways of framing ethics should be part of this collective identity building process. We should avoid unfair domination of minority cultural identities, but how do we do this when ethical discourses themselves tend to be shaped by particular dominant identities? We look into the case of the challenges that a particular multicultural society, the Philippines, faces in its (...) ongoing collective identity building project on three levels: ethnic and linguistic differences, the historical layers of foreign culture that have each influenced these distinct cultural identities in different degrees, and the apparent domination of Tagalog linguistic culture over others. Our answer to the question of legitimate and inclusive collective identity comes from an inter-linguistic dialogue that can be effected between cultures by harnessing similarities of ethical concepts, without compromising cultural differences. We present three different possible approaches under the following headings: Pilipino ethics, Filipino ethics and Philippine ethics, each representing a particular stance to the dominant Tagalog linguistic culture. We argue for the third option, which is the most inclusive because of how it equalizes the status of all participating cultures in the dialogue. We also draw from the possibilities afforded by the phenomena of Scandinavian semicommunication and what this practice offers in making collective identity building more inclusive. (shrink)

This empirical study explores the characteristics and degree of implementation of so-called ethics hotlines in transnational companies (TNCs), which allow employees to present allegations of wrongdoing and ethical dilemmas, as well as to report concerns. Ethics hotlines have not received much attention in literature; therefore, this paper aims to fill that gap. Through the analysis of conduct/ethics codes and the compliance programs of the top 150 transnational companies ranked by the United Nations Conference on Trade and Development (UNCTAD) ( 2007 (...) ), we carry out a descriptive and taxonomic study of these companies’ ethics hotlines. We analyze: (1) the basic characteristics of the mechanism, (2) the degree of exigency and the provision of safeguards, (3) the matters reported and the systems for reporting, and (4) the relationships between hotlines and economic characteristics of the firm. Our study compares financial and nonfinancial TNCs as well as North American and European TNCs. Our results show that many firms (especially from North America) have established these procedures. We also find some disparities between European and North American ethics hotlines that suggest differences in the orientation of the procedures. (shrink)

Se presenta una propuesta de innovación educativa, dirigida al alumnado de Educación Secundaria, fundamentada en el uso de los itinerarios didácticos teatralizados como recurso didáctico con perspectiva de género. Para su confección se pretende una metodología que privilegia los contenidos procedimentales y que fomenta el pensamiento histórico y, por ende, el pensamiento crítico. Los contenidos seleccionados están relacionados con el siglo XVI y XVII y, más concretamente, con la persecución y procesamiento de mujeres por brujería y hechicería por parte del (...) Tribunal de la Inquisición. Para ello se toma como centro de estudio el proceso que se llevó a cabo en Córdoba contra Leonor Rodríguez, lo que llevará al alumnado a reflexionar y a preguntarse sobre los estereotipos de la mujer en la historia, así como en la actualidad, con la intención de formar a una ciudadanía crítica y comprometida. Background: Nurses who practice limitation of therapeutic effort become fully involved in emotionally charged situations, which can affect them significantly on an emotional and professional level. Objectives: To describe the experience of intensive care nurses practicing limitation of therapeutic effort. Method: A qualitative, phenomenological study was performed within the intensive care units of the Madrid Hospitals Health Service. Purposeful and snowball sampling methods were used, and data collection methods included semi-structured and unstructured interviews, researcher field notes, and participants’ personal letters. (...) The Giorgi proposal for data analysis was used on the data. Ethical considerations: This study was approved by the Ethical Research Committee of the relevant hospital and by the Ethics Committee of the Rey Juan Carlos University and was guided by the ethical principles of voluntary enrollment, anonymity, privacy, and confidentiality. Results: In total, 22 nurses participated and 3 themes were identified regarding the nurses’ experiences when faced with limitation of therapeutic effort: (a) experiencing relief, (b) accepting the medical decision, and (c) implementing limitation of therapeutic effort. Conclusion: Nurses felt that, although they were burdened with the responsibility of implementing limitation of therapeutic effort, they were being left out of the final decision-making process regarding the same. A lo largo de este ensayo, se abordan estas cuestiones de la mano de dos relatos que teorizan el final de la filosofía con más de cuatrocientos años de diferencia. el primer relato es obra de Thomas Hobbes. el segundo, lo protagonizan Gianni Vattimo y Richard Rorty. el juego de espejos que se estable en el texto entre ambas narrativas quiere ser una reflexión sobre la identidad del discurso filosófico y su implementación en la institución universitaria en el marco de las democracias del siglo XXI. La propuesta del artículo es pensar determinadas fuerzas políticas condensadas en la figura del archivo, tanto en su instrumentalización por la Policía Nacional de Guatemala, como en su trabajo de rescate histórico y en su representación en el material humano de Rodrigo Rey Rosa. Desde una crítica derridiana, entendemos al archivo como el lugar que designa el encuentro de una pulsión de conservación y una pulsión de destrucción; esto es, el encuentro entre fuerzas que tratan de olvidar y las que (...) tratan de construir una memoria. El archivo entonces se muestra como una figura subversiva por su capacidad para desestabilizar cualquier mandato. Además, su desplazamiento a espacios del arte y la literatura significa también una producción de sentido específica, donde el archivo es a veces crítico, a veces pacificador. Desde dicha posición, se tratará de analizar tanto el uso represor del archivo como la representación hecha por Rey Rosa, pensando su escritura como una práctica social y como un trabajo arqueológico preocupado por el rescate de una verdad forense y en relación con una justicia espectral. El propósito final es hacer una revisión crítica de los usos de la figura del archivo y sus formas en las políticas de olvido, memoria y justicia. (shrink)

Background: The first wave of the COVID-19 pandemic caused a shortage of qualified nurses in Spain. As a result, the government authorized the hiring of senior students. Objectives: To explore the ethical dilemmas and ethical conflicts experienced by final-year nursing students who worked during the first outbreak of the COVID-19 pandemic in Spain. Research design: A qualitative exploratory study was conducted using purposive sampling. Semi-structured interviews were carried out using a question guide. Interviews took place via a private video chat (...) room platform. A thematic, inductive analysis was performed of the information gathered. Participants and research context: Eighteen nursing students were recruited from two universities of Madrid, aged between 18 and 65 years old, enrolled in the fourth year of nursing studies and who were hired under a relief contract for health professionals during the pandemic. Ethical considerations: The present study was carried out in accordance with the Declaration of Helsinki, and the study was approved by the Local Ethics Committee of Universidad Rey Juan Carlos. Results: Three specific themes emerged: (a) coping with patient triage, (b) difficulties in providing end-of-life care, and (c) coping with patient death. Nursing students participated in the process of patient selection for resource allocation and ICU bed occupancy. They were shown how to care for patients who were not admitted to the ICU, in their last moments and were faced with the difficulties of applying end-of-life care. Finally, the nursing students were confronted with the death of their patients, in overwhelming numbers and under adverse conditions. Conclusions: These findings can help shed light on the ethical dilemmas and ethical conflicts faced by novice nursing students, incorporated into the workforce during the COVID-19 pandemic. Moreover, it was described that students may normalize the death due to the exhaustion and overwhelmed routine. (shrink)

El siguiente trabajo, dedicado a la memoria del profesor Mariano Álvarez Gómez, se basa en sus trabajos sobre Sófocles y reflexiona sobre la naturaleza del conflicto trágico. En Edipo Rey este conflicto se ilustra mediante la lucha entre realidad y apariencia, entre apariencia y ser, y es tanto más trágico cuanto más se obstina Edipo en conocer su origen. En Antígona, siguiendo la interpretación hegeliana, el conflicto se pone en relación con el concepto griego de phrónesis, a través de (...) los sucesivos enfrentamientos entre los principales protagonistas de la tragedia, pero se mantiene siempre abierta la posibilidad de superación de dicho conflicto. Al final, se apunta otra interpretación que afirma la imposibilidad de superarlo y la función que en ese caso asume el arte. (shrink)

Social suffering commands increasing public attention in the wake of several historical processes that have changed the ways victims are perceived. In making suffering eloquent by rendering it in conceptual form, philosophy runs the risk of muting suffering, thereby neutralizing its ability to mobilize responses. In the experience of suffering philosophy finds a limit it must recognize as its own. Yet only by fulfilling its duty towards suffering - only by having the abolition of suffering as its ultimate goal - (...) can philosophical thinking withstand a tacit complicity with injustice. Research Integrity (RI) is high on the agenda of both institutions and science policy. The European Union as well as national ministries of science have launched ambitious initiatives to combat misconduct and breaches of research integrity. Often, such initiatives entail attempts to regulate scientific behavior through guidelines that institutions and academic communities can use to more easily identify and deal with cases of misconduct. Rather than framing misconduct as a result of an information deficit, we instead conceptualize Questionable Research Practices (...) (QRPs) as attempts by researchers to reconcile epistemic and social forms of uncertainty in knowledge production. Drawing on previous literature, we define epistemic uncertainty as the inherent intellectual unpredictability of scientific inquiry, while social uncertainty arises from the human-made conditions for scientific work. Our core argument—developed on the basis of 30 focus group interviews with researchers across different fields and European countries—is that breaches of research integrity can be understood as attempts to loosen overly tight coupling between the two forms of uncertainty. Our analytical approach is not meant to relativize or excuse misconduct, but rather to offer a more fine-grained perspective on what exactly it is that researchers want to accomplish by engaging in it. Based on the analysis, we conclude by proposing some concrete ways in which institutions and academic communities could try to reconcile epistemic and social uncertainties on a more collective level, thereby reducing incentives for researchers to engage in misconduct. ABSTRACT:The profound influence of Thomas Donaldson and Thomas Dunfee’s integrative social contracts theory on the field of business ethics has been challenged by Andreas Scherer and Guido Palazzo’s Habermasian approach, which has achieved prominence of late with articles that expressly question the defensibility of ISCT’s hypernorms. This article builds on recent efforts by Donaldson and Scherer to bridge their accounts by providing discursive foundations to the hypernorms at the heart of the ISCT framework. Extending prior literature, we propose an ISCT* (...) framework designed to retain ISCT’s practical virtue of managerial guidance while answering the demands of Scherer and Palazzo’s discursive account. By subscribing to a suitable portfolio of discursively justified hypernorms, we argue, companies unlock the valuable moral guidance of ISCT*, which says to treat these hypernorms as unequivocal outer bounds to the pursuit of business and as a starting point to tailor local norms through discursive stakeholder engagement. Resumen Este artículo analiza la construcción de la infancia en las novelas El mercurio (1968), El río de la luna (1981) y Esta pared de hielo (2005), de José María Guelbenzu, a la luz de los conceptos mítico-simbólicos de Bachelard y Durand para demostrar que funciona como un absoluto primigenio al que se busca volver constantemente, pues resguarda a los personajes hasta el inminente choque con la realidad adulta. Esto para concluir que desde la adultez los personajes observan la infancia (...) con el anhelo de volver allí, lo que tiene una función paliativa mediante la memoria y la palabra, por ello, la narrativa de Guelbenzu plantea regresar al ámbito infantil desde las imágenes literarias y así conservar ese mundo de fantasía. Abstract This article analyzes the construction of childhood in the novels El mercurio (1968), El río de la luna (1981) and Esta pared de hielo (2005), by José María Guelbenzu, in the light of the mythical-symbolic concepts of Bachelard and Durand to demonstrate that it functions as a primitive absolute to which it is sought to return constantly, since it protects the characters until the imminent clash with adult reality. This to conclude that in their adulthood the characters observe childhood with the desire to return there, this has a palliative function through memory and word, therefore, Guelbenzu’s narrative proposes the return to the child environment trough literary images to preserve that world of fantasy. The combined effect of coercion (public and private pressure), self-interest (competitive advantage) and conviction (intrinsically motivated or genuine) explain why environmental issues have become a key priority for companies. While research has explored coercion and competitive advantage, the role of conviction has received little attention. This paper aims to address this gap. Conviction, which has been correlated with institutional and individual drivers, offers more stable results and a potential multiplier effect as good examples are disseminated by imitation throughout an industry. (...) While the role of imitation has drawn increasing attention of business management studies, it has received scant attention in research on sustainability. This is the second gap this paper aims to address, contributing to the literature on sustainability in two ways: firstly, we will further explore the role of conviction in environmental sustainability; secondly, employing a compartmental model of epidemic propagation, used for other social phenomena, we model the role genuine examples by leaders can play within an industry and the dissemination of good behavior by imitation. Defining genuine conviction as the voluntary mitigation of the externalities of a firm's operations beyond that required by law or the market, substantiated in the responsible behavior of its leaders, our model discovers patterns that policymakers could use to create a “sustainability epidemic”. We suggest mathematical models of epidemics can be applied to sustainability, offering a fresh perspective on the phenomenon of imitation, allowing us to discover how some cultural and social habits can be used. This article analyzes the framing of the Revolutionary Armed Forces in Razón Pública, a Colombian digital magazine, from July 2008 to July 2018. The article’s methodology combines Natural Language Processing and close reading. Results indicate that the magazine’s language primarily framed FARC as a protagonist of the peace process, and, secondarily, as an actor of Colombia’s armed conflict and drug trafficking. Shortly after Juan Manuel Santos’ first inauguration as Colombian president, some authors forecasted that the conditions were ripe for a (...) peace process with FARC. During the official negotiation, FARC was framed as enigmatic, and rational protagonist of a challenging peace process. Overall, the frames detected in this analysis are an echo of the UNDP Colombian Report that called for analytic journalism that improves the public’s understanding of the country’s complex armed conflict and proposes negotiated and military solutions. On August Business Roundtable, the Business Roundtable redefined the purpose and social responsibility of the corporation. Yet, this statement must be followed by substantial changes in the business models of corporations for it to avoid becoming empty rhetoric. We believe that the figure of the independent director may be one of the catalysts needed for this change of paradigm for corporations. In spite of the positive correlation between Corporate Social Responsibility and board independence, the development of the independence of boards (...) during the last decade has not lead to the expected CSR results. Academics and regulators point to a weak definition and the non-standardized measurement of both independence and board independence as one possible explanation, and agree that a broader definition is needed. This paper aims to contribute to this debate. We develop a second-generation definition of independence based on a positive approximation to the concept by integrating an Aristotelian perspective of virtue ethics with the best practices of corporate governance. Thus, we define independence as a virtue guided by practical wisdom, that implies autonomy and autarky and which enables a person to act with integrity, fairness and truthfulness. In the context of corporate governance, independence is associated with an honest disposition to serve. Our proposal has political implications for supervisors that make decisions relating to the suitability of board members. (shrink)

La participación masiva de los jóvenes respecto a los sucesos políticos estuvo aquietada por muchos años; sin embargo, con el posicionamiento de las comunicaciones a nivel global, la generación millennial se va involucrando cada vez más. Es así que en el marco de la democracia representativa de develar una participación cada vez más activa, ahora los jóvenes comunican su sentir y su postura, mostrando su conformidad o disconformidad con las decisiones y acontecimientos políticos. Partiendo de esta premisa, y con un (...) enfoque mixto, se aplicó un cuestionario de 16 preguntas a 3474 millennials, estudiantes de institutos superiores y tecnológicos ubicados en Lima; además, se realizó un análisis de las declaraciones de académicos y jefes de Estado, así como de casos internacionales donde se destaca la participación de esta generación, como aconteció en la Primavera Árabe y en otros sucesos ocurridos en Sudamérica, para vislumbrar las brechas que se abren en la estructura política del Perú. Entre 1927 y 1933 Walter Benjamin escribió guiones radiofónicos que fueron transmitidos en Radio Berlín y Radio Fráncfort, y que él mismo actuó y narró al aire, o bien, dirigió y participó en su producción. Aunque el propio Benjamin veía con cierto desdén esas colaboraciones, y de forma similar lo han hecho los estudiosos de su obra —en buena medida por dirigirse al público infantil—, estos trabajos resultan en particular relevantes porque concretan los postulados teóricos del filósofo berlinés en términos (...) de forma y contenido. Este artículo busca mostrar la coherencia entre el trabajo que Benjamin realizó para la radio y su obra filosófica; explorar aquellas piezas radiofónicas para destacar su filo crítico y la manera en que manifiestan la búsqueda presente en Benjamin desde sus escritos de juventud: el despertar del sueño de la modernidad capitalista.
